  • Trial Attorney that is responsible for all aspects of case management, including trial and arbitration. A seasoned advocate with effective courtroom skills and in-depth knowledge of medicine and malpractice litigation. (Los Angeles, Orange County, & Walnut Creek)
  • Litigation Attorney that is responsible for all aspects of case management. The ideal candidate will have an in-depth knowledge of medicine, law and issues related to medical malpractice litigation and the skill to develop effective case strategy. (Walnut Creek)
  • L&M Appeal Attorney that is responsible for drafting appellate briefs and motions / applications, and complex motions and pleadings on CAPIC litigated matters. (Los Angeles)

Essential Duties and Responsibilities

  • Represent CAP physicians, hospitals or entities covered by MPT or CAPIC in medical malpractice lawsuits as the lead trial and arbitration attorney; prepare and successfully try and arbitrate cases as requested
  • Work with trial and arbitration attorney
  • Formulate creative discovery and investigation strategy
  • Obtain concurrence with claims specialist on defense preparation and ensure cost-effective completion
  • Prepare pleadings and respond to discovery
  • Attend court appearances as required or by court call
  • Responsible for compliance with the Defense Attorney Guidelines by all legal staff working on assigned cases
  • Respond to “hotline” inquiries from the Claims Department
  • Ensure timely reporting of information / status to claims and client at all stages of litigation
  • Represent Member physicians at deposition in “Depo-only” cases
  • Perform other duties as necessary

  • Designate, review, and analyze lower court records and other documents
  • Research and analyze case law, draft persuasive briefs, as well as appellate motions and applications, and appellate documents
  • Assist both in-house and outside trial panel counsel in framing issues at trial and in preserving the record for appeal
  • Advise both in-house and outside trial panel counsel and claims specialists regarding writ petitions
  • Support Law and Motion Team

  • Provide support to attorneys as requested in litigation matters to successfully try and arbitrate cases
  • Formulate creative pleading and motion strategy
  • Obtain concurrence with claims specialist and attorneys for law and motion pleading and strategy
  • Attend court appearances and argue motions
  • Client Relations

  • By philosophy and example, demonstrate to all involved that client service and satisfaction are a priority
  • Excel in gaining recognition for client satisfaction. Work well in difficult, emotionally charged situations while maintaining a calm demeanor
  • Constantly seek feedback from clients to provide a positive working relationship between the clients and the firm
  • Review, respond to, and resolve all client complaints / concerns to ensure client satisfaction
  • Perform other duties as assigned
  • Education and / or Experience

  • J.D. Degree
  • Other Skills and Abilities

  • Licensed to practice law in California
  • Ability to lead and motivate others on the team to accomplish research, investigation, and trial preparation responsibilities
  • Ability to mentor, train and build team enthusiasm among staff counsel
  • Ability to assist as second chair in trials and arbitrations and, in appropriate cases, to take the lead as trial and arbitration counsel
  • Ability to work independently
  • Starting Salary : $150,000 - $200,000 (Depending on Experience)
